National Interest Waiver (NIW)

A National Interest Waiver is a path within the employment-based green card process that lets certain applicants move forward without their employer completing the standard labor certification step. It's one of our most frequently handled case types.

How We Help

We start with a consultation to understand your work and how you’d like to move forward. From there, we use a detailed questionnaire built specifically for NIW cases — we keep versions in English, Spanish, and Portuguese, since we work with applicants from a range of backgrounds. Once we’re engaged, we prepare the petition and the full supporting record, working closely with you to gather the documentation your case is built on. If the government requests more evidence, we build that response with the same care we put into the original filing, and we keep you posted throughout the process — including during the long waiting periods this case type can involve, rather than going quiet once it’s filed.

What to Expect Working With Us

NIW cases are personal — they’re built around your own work and background, and we take the time to understand both before we start drafting anything. We’ll ask a lot of questions, some of which might feel unusual at first, but everything we ask for is in service of building the strongest record we can put together for you. We explain what each document is for, and once your case is filed, we don’t disappear — we stay on top of it and keep you posted as it moves along. Consultations and case communication are available in English and Spanish, and our NIW questionnaire is also available in Portuguese.
